Born in Subiaco, Western Australia in 1906, Herbert McClintock is a nephew of Alexander McClintock. The family moved to Melbourne and he studied art at night classes at the National Gallery of Victoria. In 1930 he joined the Communist Party of Australia and began drawing political cartoons for left-wing newspapers, and the same year in Melbourne, exhibited in his first joint exhibition. He moved to Sydney in 1940 and was appointed an official war artist, and was a founding member of the Studio of Realist Artists in Sydney. A retrospective exhibition of his work was held in Melbourne in 1980. Under the pseudonym of Max Ebert he painted in a surrealistic style, later turning to social realism.
